A security guard who was watching the crowd at Ralph Wilson Stadium when two players bowled him over last season said he is suing the Buffalo Bills because of a knee injury he suffered in the accident.

Bill Austin, 49, of Wheatfield, was on the sideline when Bills wide receiver Lee Evans, who had just caught a touchdown pass, and Kansas City cornerback Eric Warfield rolled off the field and into him Nov. 13. more (http://www.buffalonews.com/editorial/20060722/1053677.asp)

In the good ole' US of A, anybody can sue anybody for any reason. But I'm surprised that this guy didn't sign a waiver, or have something in his contract, that would hold the Bills harmless for certain types of injury, including this one.

He knew the risks going into the job. Its not like the conditions caught him off guard. Just another way for lawyers and someone taking advantage of the system.

Didn't the Bills pay for his medical? I thought that they did....

You're probably right, because apparently he is suing the Bills for "pain and suffering" - not his medical bills - due to the team's "negligence."

He's a typical greedy bastard with an even more typical greedy bastard lawyer.

If the Bills paid for his medical and he made enough of a recovery that he is still able to work. He doesn't deserve anything else IMO.

I'm stunned the Barnes Firm is not representing this guy. They love suits like this one.

So what is the negilgence going to be? Let's see...not installing a concrete wall on the sidelines so that the receivers, who are running at full speed, hit it like a bugs on a windshield? If you are anywhere on the field during play you assume a risk. The only thing that I can see is mandating employees to wear ***** helmets and pads like the players. Otherwise there is no physical barrier you can construct without endangering the players.

His knee is still screwed up. The bills told him he isn't coming back. And there was supposed to be a spotter to tell him to move.

Read the article.

I LMAO'd when Evans ran into him. Probably more out of joy that the Bills had actually scored a touchdown and Losman actually threw one.

Actually his lawyer said they should have spotters. Not that should have been one there previously.

Getting hurt is gonna be the best thing that ever happened to him. You know he's gonna settle out of court for a nice chunk of change

I worked part time for CSC, the company that does security for most NFL teams, this past season here in Atlanta at the Georgia Dome. I got to work down on the field too for a few of the games and I'm pretty sure we had to sign some kind of waiver when we got hired saying that our clients weren't responsible for injury or something like that.

Well, if their job is to watch the crowd (and have their back to the game) then not having spotters could very well be negligent.

this is just like XXXXX *insert band name* XXXXX in concert..... someone hurts a guard, and sues the band...........

most places as far as i know require waivers against suing the venue/team/management, but leaves the band or individuals free to be sued

Fleming, who said there at least should have been spotters to tell guards not facing the field to move, said "something was bound to happen sooner or later, if not to him, then someone else. It was reasonably foreseeable that there would be an injury."

The guy makes a good point.

I don't think he was quite that big but he certainly wasn't in shape as I remember.

Didn't he fall on the Chiefs' corner? I wish someone would dive underneath me when I fall at my job. The corner should sue him. And most importantly, did he get to keep the jacket?

Somehow I doubt Aimee realized it was that serious when it happened. Photographers and other people on the sideline get knocked down all the time.

You know, people should have a little responsibility for their own actions. Even though the Bills "supposedly" told this idiot not to ever turn his back to the stands, wouldn't a reasonable person have turned their head - at least for the few seconds that a play was in progress - to at least be sure they they weren't in harm's way?

Jeez. do we have to reward every moron for their stupidity?
