    McNair Arrested

    Steve McNair was arrested and charged under Tennessee's "DUI Owner" law Wednesday morning when he was found to be riding in a car he owned that was being driven by his intoxicated brother-in-law.
    In Tennessee the owner of the vehicle can be charged with DUI if he's a passenger while the intoxicated person is driving, whether or not the owner is intoxicated him or herself. It's unknown whether McNair was drunk. This is the second DUI arrest for McNair; he was arrested in 2003 on charges of drunken driving and illegal gun possession.

    What probably happened is that he had 7 beers and his brother in law had 4. So he said hey I'm pretty buzzed and you're in better shape than me so why don't you drive. He did the right thing and got busted for nothing. It's dumb.

    BTW, DUI stands for Driving Under the Influence. If he wasn't driving, how could it be DUI?

              that is the most ridiculous law I've ever heard in my life. I can't believe the law itself hasn't been challenged in court yet.

                            There is no law against driving to a bar/party etc sober. There is no law against getting drunk in a private establishment. Therefore, the person in the passenger seat hasn't done anything wrong- if you're too drunk to drive, obviously your ability to know someone else's state of inebriation is also impaired. The owner of the car shouldn't be held responsible for someone else's decision to drive drunk. This law is nothing but a knee-jerk reaction by anti-alcohol puritans.
