Two youths face federal charges arising from a prank that became less humorous once they realized they had violated federal law.
Joshua Barber, 20 and Nicholas Kaiser, 20, of Plymouth, Massachusetts arranged a phone call between former Bills G.M. Buddy Nix and Buccaneers G.M. Mark Dominik. Then, Barber and Kaiser recorded the call without the knowledge of Nix and Dominik.
Per WGRZ-TV, Barber and Kaiser now face federal charges (http://www.wgrz.com/news/article/216209/116/Two-Charged-With-Recording-Phone-Call-Between-Nix--Dominik) of “intentionally intercepting a wire communication and with making a telephone call without disclosing their identity with the intent to annoy or harass the person at the called number.”
The situation came to light when the man-children, oblivious to the fact that any law had been broken, forwarded the fruits of their pranks to Deadspin, which published the call.
We knew (http://profootballtalk.nbcsports.com/2013/03/12/bills-bucs-refer-matter-of-intercepted-phone-call-to-nfl-security/) from the moment we saw the story that criminal charges would be coming. The buzz at the league meetings in late March was that the men will be charged, with the goal of scaring them straight — and of sending a strong message to others who may be inclined to record phone calls secretly, and nonchalantly.
The prank began with the men trying to call Nix’s office. When they got through to his assistant, they left a message from Dominik. Nix then repeatedly tried to call their phone, looking for Dominik.
They decided to try to complete the phone-a-friend-clusterfudge by contacting Dominik and pretending to be Nix. As they were in the process of contacting Dominik, Nix called again. They decided to link the two up and let nature takes its course.
Now, the legal system will run its course. If the defendants are lucky, they’ll get probation or some other outcome that won’t entail jail time. If they were smart, they never would have secretly recorded the call, and they definitely wouldn’t have forwarded it to a media outlet.

I'd bet they're not laughing now, facing up to 5 years in prison and a $500,000 fine. I don't think they'll get anywhere near the max, but I doubt they walk away 'scott free'. You don't pull dumb pranks on something as powerful as an NFL team, then brag about it.

Wonder if they are Patriot fans since they are from Plymouth, MA. If so I say throw the book at them!

My question is at what point do Nix and Dom realize that neither one really called the other and they really have nothing to talk about? Didn't they realize that neither one of them actually initiated a conversation? Well the answer is a resounding NO since they went on like a couple of school girls talking about their teams. ****ing clownshoes.

Well, there's also the inverse of that: the prank never would have worked if Buddy Nix wasn't a fumbling old codger with no understanding of cell phones.

torn on this, if the kids are bills fans and just proving a point, then they should be treated with leniency. if they are pats fans, i believe gitmo would be appropriate.

So glad the Justice Department sees fit to prosecute people for prank phone calls.

I wonder why they didn't prosecute Buddy when he called that preacher a few years back?

What about Deadspin? They were the ones who broadcast a call that was illegally recorded, were they not? Its not like this is a whistle blower issue. Why are they not accomplice to the crime?

I say throw the key away. None of the bankers that brought down our economy will see a day of jail but dammit when it comes to prank calls we need to send a message!

They won't see a minute of jail.

You'd think that since they were smart enough to pull this stunt off that they would have been smart enough to give the call to Deadspin anonymously.

They were paid by Deadspin, that's one think that makes this more than a little prank, they profited from it.

That's what was funny. They just went with it. Busy time, everybody is looking for something at that level, so it was an easy prank. You can't blame Buddy's age for it. Dominik is only 42. If anything that's worse than the old guy falling for it. They got duped. The part that really put Buddy in a jam was what he was saying about the QB situation at the time.

It really wouldnt have mattered if they had submitted the tape anonymously. Once the story broke and the authorities notified, the cops would have no problem obtaining phone records which would show who had placed those calls...
