    Carruth's appeal for new trial denied

    RALEIGH, N.C. (AP) -- Former Carolina Panther Rae Carruth lost a bid Tuesday for a new trial on his 2001 murder conspiracy conviction despite an error by a lower court.

    A state appeals court ruled that although the trial judge shouldn't have allowed handwritten notes from the victim to be admitted, the notes didn't prejudice the jury because of the overwhelming evidence against Carruth.

    Carruth's lawyer, Gordon Widenhouse, said he would seek an appeal before the state Supreme Court. He said the notes were the strongest evidence prosecutors had to make their case that Carruth was involved in a conspiracy.

        Carruth not contesting wrongful death lawsuit

        CHARLOTTE, N.C. -- Former Carolina Panther Rae Carruth, serving prison time in connection with the 1999 murder of his pregnant girlfriend, will not contest a wrongful death lawsuit filed by the victim's mother.

        Carruth appeared last week in civil court, where his lawyer Chris Fialko told Superior Court Judge Robert Johnston that his client wanted to withdraw his answer to a civil complaint filed by Saundra Adams in December 2001.

        The withdrawal of the answer, which was filed in February 2002, means that Carruth defaults on the lawsuit and the court will treat him as though the allegations in the suit are true.

          N. C. Supreme Court declines to hear appeal

          RALEIGH, N.C. -- The state Supreme Court on Thursday declined to hear the case of former Carolina Panthers wide receiver Rae Carruth, who was convicted in the 2001 murder conspiracy of his girlfriend.

          Without comment, the state's highest court declined a request by his attorneys for the justices to hear his appeal.

          In August, the state Court of Appeals declined to give Carruth a new trial although the three-judge panel determined the trial court had made a mistake in his case.

              $5.8 million in damages sought from Carruth

              CHARLOTTE, N.C. -- Former Carolina Panthers receiver Rae Carruth and three men convicted of conspiring to kill Carruth's girlfriend should be ordered to pay about $5.8 million in damages to her estate, a lawyer for the girlfriend's mother told a judge Monday.

              The request by attorney Billie Ellerbe came during a hearing in Saundra Adams' wrongful death lawsuit against the men.

              All four were found guilty in 2001 of conspiring in the Nov. 16, 1999, shooting of Cherica Adams, who was eight months pregnant with Carruth's child. She died about a month later; the baby survived but has cerebral palsy.
