The alleged victim in the felony assault case against Bills linebacker Von Miller has apparently recanted her contentions.

Miller faces a felony charge of assaulting a pregnant person earlier this week in Dallas. Earlier in the day, details emerged regarding the alleged incident.

Via Alaina Getzenberg of ESPN.com, the affidavit supporting the arrest warrant (https://www.espn.com/nfl/story/_/id/39013616/warrant-issued-bills-von-miller-alleged-assault) shows that an argument began on Wednesday morning, at roughly 10:40 a.m. local time. It started, per the affidavit, over the travel plans of the alleged victim.

Absent some explanation that hasn't materialized yet, it's kind of hard to believe what was described in the report didn't happen. Perhaps she was scared or angry in the moment and made the call. Then when the situation abated realized the financial and reputational consequences. It should be up to her how she wants to handle. Not what I'd advise my daughter, but people should be allowed to make their own choices.

That said, my kid went to school yesterday in a #40 Miller jersey and when he came home it was rolled up in his backpack. Really sad all around.

This situation is ample evidence for why it's always foolish to jump to conclusions rather than wait for the whole thing to play out. Miller might or might not have committed assault. All kinds of things can be reported in the news when something like this happens. You can't really trust any of it to be true. Assuming Miller is free in the short term I don't really think the Bills should play him. His contribution has been minimal anyways. On the other hand, they shouldn't and won't cut him either. They should wait for the league to investigate and respond with its own action. If Miller is suspended, the Bills will receive some relief on the money owed to Miller under the contract. That will result in significant salary cap relief. If they cut him now, they forfeit that salary cap relief.

But they won't because if she doesn't testify, or testifies only to recant the affidavit, they'll never get a conviction.

They have physical evidence of the bruises and other injuries she suffered, but they only evidence regarding who did it came from the victim's mouth. If she stops saying that Von did it, there's no other evidence that he did. Of course, we all know that he did it, but that doesn't come close to the "beyond a reasonable doubt"

It puts the team and the league in a tough spot. It looks like he is going to skate on actual legal trouble. The team and the league aren't bound by the same evidentiary standards as prosecutors are, but where do they draw the line? They have to find a balance between punishing players who commit domestic violence vs creating a situation where any accusation can get a player in trouble, regardless of truth.

Of course, this is just another way in which our legal system is unjust. If you or I did this, we would be in jail (and rightfully so). But people with enough money and enough celebrity status can buy their way out of legal trouble, even when they deserve to be locked up.
