Yeah, it sort of makes sense but won't make Brady look good, which doesn't seem to be the point anyway, even to Brady.
I have a feeling it will hinge on the NFL adopting a pseudo legal process without it being a real legal process. Brady's lawyer mentions the legal technicals the "defense" wasn't subject to while having to adopt the "legals" the NFL decided gave it their best pseudo legal case, arbitrarily.
Whether or not Brady is right or wrong on a personal/player level, the NFL's legal not legal facade subject to itself is going to take a wicked beating if this gets before a judge in a real court of law where they try to pretend it is real law against real law.
In a nutshell, I guess what I'm saying is that Brady can't win in the court of public opinion, but the NFL comes out worse in the court where it matters. Like you can't cite due process as a legal basis when you didn't give one.
It's not even going to be about whether or not Brady really even did anything.
Why is it peculiar? I'm sure there's lots of stuff on there pertinent to the situation. As I'm sure there's also all sorts of stuff NOT pertinent to the situation that the NFL hanging judges get to see?
Demanding people turn over their cell phones after the fact is defacto bugging their telephones without a warrant. Can the NSA override it? For national security reasons but deflated footballs? Tom Brady might have had very good reasons other than admissions of guilt to want to keep his PRIVATE correspondense private.
Look, if your boss, on a tip from a fellow employee who hates you, accuses you of cheating on your expense reports and demands you turn over your cell phone, do you have the right to tell him to **** off? Why should your boss be able to invade your privacy just so you can try to prove a negative? It's ridiculous.
Oddly enough, this reminds me of the run up to the Iraq War, where nothing Saddam could do or say would convince people he didn't have WMDs. And when Saddam balked at some of the more ridiculous requests, everyone tsk tsked about him hiding things and used the famous old police state homily, "If you've done nothing wrong, you've got nothing to hide".
