I've heard the story that's circulation from several reliable sources. The only thing I know is that nobody knows what happened except the people involved.

Somebody asked a question online today about settlements. To paraphrase, if you were accused of rape and you were innocent, wouldn't you spend every last dime to clear your name?

Fair question. But it brings to mind another question.

If you were raped, would you accept money instead of seeing your rapist go to prison, especially when there's a very good chance that he would be convicted and you could sue him in civil court?

If this is settled with a payoff, it creates more questions than it answers.

Here's the thing: the trial will be a spectacle. She'll have to give depositions and testimony in court and reporters will bound her and Blackhawks fans will harass her on social media.

If it were me, I'd take the money to make it go away.

But, this just shows the two-tiered justice system. If Kane really did rape her, he's probably gonna do it to someone else. But he remains free because he has the money to buy his way out of it. If it were you or me, we would be going to jail because we don't have the money to pay off the victim.

DNA evidence does not confirm a woman’s allegations that Patrick Kane raped her, four sources familiar with the case told The Buffalo News.

DNA tests taken from a rape kit conducted on the woman showed no trace of Kane’s DNA was found in the woman’s genital area or on her undergarments.

The lack of that DNA evidence does not necessarily mean a sexual assault did not occur, legal experts say, and the evidence involved in this type of investigation typically consists of more than just DNA. The investigation continues, and Kane has not been charged with any crime.

Authorities are examining other evidence trying to determine what happened between Kane and the woman at Kane’s lakeshore home in the Town of Hamburg early on the morning of Aug. 2.

“The absence of DNA and semen, in itself, does not prove that there was no rape,” said Florina Altshiler, a Buffalo attorney who worked as a sex-crimes prosecutor in Alaska. “It proves that there was no ejaculation, or possibly, that the perpetrator wore a condom.”

Altshiler said she is aware of cases in which rapists did wear condoms.

Frank J. Clark, the county’s former DA, offered a different opinion.

If none of Kane’s DNA was found on the woman’s genital area or in her undergarments, that information “could be a game-changer” in Kane’s favor, he told The News.

“If the vaginal swabs taken at the hospital show no sign of his DNA, that could very well exonerate him of rape,” Clark said.

Yup. Physical evidence is mandatory in such a case; otherwise it's just the word of an unknown woman against future NHL HOF'er, and successful multi-millionaire, Patrick Kane. DA wouldn't touch such a case with a 10 ft pole. Patrick Kane can afford the very best defense team money could buy. So the odds are it would be totally flushing hundreds of thousands of taxpayer dollars down the drain for an expensive (and embarrassing to Buffalo, and the DA) trial; plus it would hurt the DA's conviction to trial ratio.

There still could be DNA with a condom. Hair, for example. Unless he man-scapes but that's a detail I'd rather not know.

Also even if they find DNA it proves sex. It doesn't prove if it was consensual or not.

Thomas Eoannou, the attorney for the woman accusing Patrick Kane of rape, held a press conference today and claimed that the rape kit, which had reportedly shown no signs of Kane’s DNA, was tampered with. Eoannou discovered this because the rape kit was left outside the accuser’s mother’s house.

This is breathtakingly obscene. The accuser’s rape kit should never have left the police station, since it’s evidence. It also throws into doubt the leaked reports on the DNA testing, and the motives of the sources for those leaks.


It’s not at all clear what happened here. Was this an attempt to taunt or intimidate Kane’s accuser? Or was it, as Eoannou said he hopes, a “good Samaritan” trying to tip off the accuser to the tampering?

If this is true, the Buffalo PD so thoroughly botched the investigation that they need to start answering questions from the NY attorney general. What a catastrophic cluster ****.

A second rape kit didn't show up. A bag that allegedly held the kit showed up. The evidence is in the hands of he Erie County Sherrif's Office and per their statement, still is in its original packaging and undisturbed.

why don't we all just let this play out and see what is learned before everyone douches their tampons maroon.
