    Dershowitz: Articles of Impeachment Don't Meet Constitutional Standards

    Constitutional law expert and Harvard professor emeritus Alan Dershowitz harshly criticized the articles of impeachment against President Donald Trump presented by the Democrats as unconstitutional and damaging to the rule of law in an op-ed in The Hill on Tuesday.

    Neither of the two articles - abuse of power and obstruction of Congress – presented by the Democrats “satisfies the express constitutional criteria for impeachment,” as both are not crimes or even mentioned in the Constitution.
    This means that the Democrats are placing themselves above the Constitution, he wrote.
    Dershowitz argued that both articles of impeachment “are so vague and open-ended that they could be applied in partisan fashion by a majority of the House against almost any president from the opposing party.”

    More than 500 legal scholars have signed on to an open letter asserting that President Trump committed “impeachable conduct” and that lawmakers would be acting well within their rights if they ultimately voted to remove him from office.

    The signers are law professors and other academics from universities across the country, including Harvard, Yale, Columbia, the University of California at Berkeley, the University of Michigan and many others. The open letter was published online Friday by the nonprofit advocacy group Protect Democracy.

    I'm not saying Dershowitz is right or passing judgement on whether the impeachment details are constitutional, but I don't know how much legitimacy I would give to that format.

    The difference between this and the stuff sukie posts is the people named in the letter are real people with real credentials and it's posted on a major self-publishing platform. Google the names; they are who they say they are and they're *lawyers* to top it off... so this would get shut down immediately if it wasn't authorized. Especially after getting the attention of a major news outlet like the Washington Post.

    You or I (or anybody) could also google any law professor in the country, get their publicly-listed email, title and institution and sign up as them.

    So you are willing to give the petition a certain level of legitimacy under the premise that you know it could be at least partially motivated by bias as opposed to an objective interpretation of the law?

    I'm saying the likelyhood of that is incredibly low for two reasons:
    1. They would have to create 500+ legit looking linkedin profiles and respond to a confirmation message through linkedin to confirm the identities
    2. These people are lawyers. If their names are being used without their permission you don't think this would be circulated and taken down immediately?

    I am being realistic about the limits of communicating through human language (and written law) and the fact that there is no way to prove or disprove bias. If every one of these people had an anti-Trump tattoo on their foreheads that is still not proof of bias, just a strong hint.

    At some point in your reasoning you have to establish certain levels of trust especially when dealing with matters that are outside of your realm of expertise. All of civilized society is built upon that trust.

    2020 is going to be exciting! Our country got itself into a complete mess 4 years ago (really 12 since the right stonewalled Obama every chance they could) and it's going to be interesting to see the next chapter unfold leading up to November. It's ****ing comical...and sad.

    We tend to idolize the Founding Fathers and view the Constitution as infallible but they got a lot of things wrong.

    Yes, the Constitution is the supreme law of the land. It is not infallible. The vagueness on impeachment is one of the glaring weaknesses.
